Privacy policy

First of all the most important: We from myAustrian virtual do not process, apart from your name, personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership and data concerning health or sex life. We are a well-established and renowned virtual airline (VA) and we would not do anything with your data you would not expect from a virtual airline. Nevertheless it is necessary to protect ourselves by defining legal provisions, in order to, for instance, globally publish your membership on our website or to host our website at webhosters. Please note the meaning of a VA is to compare yourself with your VA collegues, to publish your achievements in the VA and to present and publish your activity in the VA. This and more is to be found in the following provisions which you must accept if you want to become a member of our association and our virtual airline.

In the event of discrepancies between the English version of this text and the German version of this text, the German version will be the sole authentic version and will prevail.

The terms contained herewithin referring to personal data will apply both to personal data having been obtained from the data subject and personal data not having been obtained from the data subject.

The purpose of the processing for which the personal data is intended is the fulfillment of the purpose of the Association. The purpose of the Association is the establishment, operation and development of one or several virtual airlines. A virtual airline (hereinafter referred to as "VA") within the framework of the Association's by-laws is a platform by means of which persons simulate the operation of an airline. The meaning of a virtual airline is, inter alia, to compare yourself with your VA colleagues, to publish your achievements in the VA and to present and publish your activity in the VA, the latter in particular globally on websites. Furthermore, the meaning of a virtual airline is to enable establishing contact with your VA colleagues and to exchange experiences with them. The legal basis for the processing is the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) in conjunction with the Association's by-laws.

The recipients of the personal data are the controller, possible processors, further data subjects and third parties.

For the controller's website being retrievable globally, the controller intends to transfer personal data to third countries and international organisations. An adequacy decision by the Commission is absent.

Pseudonymised personal data, messages sent through the information and interaction platform on the internet (website, forum), posts in forums, wikis and on the VA helpdesk, as well as any other data revealed to the Association in the course of communication will be stored until further notice. Other personal data will be stored for the duration of membership of the data subject in the Association.

Each data subject has the right to request from the controller access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability. The Association reserves its right to terminate the membership of the respective data subject in the Association if, in the view of the Association, the erasure or restriction of processing of personal data, or the establishment of objection to process personal data would lead to the purpose of the processing for which the personal data is intended is not fulfillable any more.

Each data subject has the right to withdraw consent to this privacy policy at any time. The lawfulness of processing based on consent before its withdrawal will remain unaffected.

Each data subject has the right to lodge a complaint with a supervisory authority; in Austria with the Datenschutzbeh├Ârde (Austrian Data Protection Authority).

The provision of personal data is a requirement pursuant to the Association's by-laws and for the purpose of fulfilling the purpose for which the processing of the personal data is intended. Each data subject is obliged to provide the personal data. Failure to provide such data would lead to denial of membership in the Association, respectively to the termination of membership in the Association.

Automated decision-making, including profiling, does not exist.

The categories of processed personal data not having been obtained from the data subject are:

online activity within VATSIM and/or IVAO network;
Association ID number and/or virtual airlines ID number;
functions and ranks within the Association and the virtual airlines;
authorisation for extended access to specific parts of the Association's or the virtual airlines's services;
warnings and bans;
online activity on servers of the Association or of the virtual airlines;
data which is submitted by means of an ACARS client, as well as data derived therefrom.

This personal data originates from these sources:

VATSIM and/or IVAO network;
assignment and definition by the controller;
analysis and processing of online activity on servers of the Association or of the virtual airlines by the processor;
analysis and processing of data which is submitted by means of ACARS clients.

This personal data, hence, partly comes from publicly accessible sources.

Should a person - for whatever reason - gain unauthorised access to data, this person must inform the Association's Executive Board without delay. The gained information must be handled confidentially.

Data subjects's personal data available to persons because of their status as further data subject or as the controller must not be processed beyond the scope of the purpose of processing as explained above without the data subject's explicit approval and consent.

It is agreed that the Association does not take liability for the correct, actual, current and prompt provision of data provided by and automatically retrieved from the VATSIM and/or the IVAO network.

It is explicitily recommended, for reasons of data privacy, to abstain from providing and publishing data other than this data mandatorily required during application as member or registering at the forum. The Association does not take liability for a possible misuse of such optional data by third parties.

The usage of data provided by the Association in its imprint or likewise information, such as addresses, telephone and fax numbers, e-mail addresses, by third parties for the purpose of sending information which was not explicitly requested by the Association is prohibited. The Association explicitly reserves legal actions against the originator of such "spam mails".

During registration, application for membership, usage of forums, wikis, VA helpdesk and other parts of the website cookies will be used and stored; this is done for the sole purpose of identifying the user and saving certain settings for better usabilty. No other data is collected by these cookies. It is noted that for the purpose of websites access counting the IP address and the user name will be stored. This data will only be used for showing anonymous website access statistics.
